Herald case: Swamy urges HC to reject Congress' appeal

BJP leader Subramanian Swamy on Wednesday asked Delhi High Court to dismiss the Congress leaders’ pleas seeking stay on the trial court’s decision of summoning the 2010-11 balance sheet of Congress and documents from six Government departments in National Herald case.

Replying to the objections raised by the battery of Congress lawyers led by Kapil Sibal and Abhishek Singhvi, Swamy said accused have no right to say what the Magistrate want to examine during the trial.

Sibal and Singhvi on Monday argued that Magistrate lovleen had erred in passing the orders by not seeking their response. “These people are accused and they have no right to say what a trial court judge wanted to examine as evidences in the case. They are no body and no locus and these are all attempts to delay delivery of justice,” said Swamy.

He also told Justice PS Teji that all the six Government departments have submitted documents before the trial court and there is no point in entertaining the appeal of Congress leaders. Except Sonia Gandhi and Rahul Gandhi, all other accused including Motilal Vora and Oscar Fernadez filed appeal against the trial court’s order.

The arguments remained inconclusive which will resume on April 18, when the counsel for the accused will make rebuttal to Swamy’s contentions.

Meanwhile, the Congress party and national

Herald newspaper’s

publisher Associated Journal limited are expected to submit their accounts on Friday in trial court. It is expected that the Congress would seek more time, pointing out the ongoing arguments in the High Court.
