Cessy Xavier, the glamorous lady who made hundreds of head turn in the district court premises of Alappuzha where she practiced claiming that she was a qualified lawyer, was asked by a single judge Bench of Kerala High Court to surrender before the authorities for interrogation. Judge V Shircy on Friday dismissed the anticipatory bail petition moved on behalf of Xavier who had no legal qualifications to practice as an advocate.
The controversial woman had been practicing in courts in Alappuzha for two years without any degree in law. She even managed to get elected as an office bearer of the district bar council using her friend’s credentials.
The prosecution had opposed Xavier’s bail plea on the ground that some of the offences alleged against her were non bailable and she should be subjected to custodial interrogation to know she managed to get enrolled as an advocate using fake credentials.
The prosecution along with the bar council told the Court that it was imperative to ensure that such fake activities are not repeated in future.
Xavier’s façade as a qualified lawyer came down following the discreet probes made by members of the bar council about her educational and professional backgrounds.
A First Information Report was registered against Xavier for offences punishable under Sections 417 (punishment for cheating) and 419 (punishment for cheating by personation) of Indian Penal Code, both of which are bailable offences. Subsequently, offences punishable under 420 (cheating and dishonestly inducing delivery of property) was added which is a non-bailable offence.
The case was a topic of discussion in Kerala especially in the backdrop of the principal character being a glamorous woman and many persons have been bowled over by her through her good looks and skills of communication.
