HC dismisses BSY's plea in illegal mining

There was no respite for former Karnataka Chief Minister and KJP president BS Yeddyurappa who is facing kickback charges in illegal mining and land denotification row. A single bench of the Karnataka High Court on Tuesday dismissed Yeddyurappa’s plea seeking quashing of two private complaints against him before the lokayukta court alleging denotification of lands.

Justice Anand Byrareddy dismissed the plea of Yeddyurappa, observing it was “premature” at this juncture and also directed him to approach the lower court stating that it was the correct forum.

Yeddyurappa, his two sons -- BY Raghavendra, a lok Sabha member, and BY Vijayendra -- and his son-in-law RN Sohan Kumar are among those named in the complaints filed by advocate Sirajin Basha.

The two complaints pertain to alleged illegal denotification of lands in Rachenahalli, Vayali Kaval House Building Cooperative Society area and HSR layout in Bangalore.

In another development, the same single judge bench of the Karnataka High Court on Tuesday dismissed the criminal petition by former Industries Minister Murugesh Nirani seeking quashing of the FIR and chargesheet filed against him in the lokayukta court in connection with a private complaint that he illegally ordered cancellation of an industrial site based on a forged signature. Nirani once with Yeddyurappa deserted him at the time of the elections and contested from the BJP and lost in Bilagi constituency in the recent Karnataka Assembly polls.

Justice Anand Byrareddy dismissed the petition on the grounds that since the chargesheet was still pending before the Special Judge of lokayukta court for taking cognisance, it was not a fit case for any kind of interference at this stage.
