The Government is contemplating the option of a fresh Supreme Court inquiry against Justice (retd) AK Ganguly and whether a criminal case can be filed by the Delhi Police against the former judge of the apex court, who is now the chairman of the West Bengal Human Rights Commission.

According to sources, the Home Ministry’s move came after President Pranab Mukherjee sought its opinion on the two letters of West Bengal Chief Minister Mamata Banerjee, demanding removal of Ganguly from the post of chairman of State Human Rights Commission.

The chairman of State Human Rights Commission can only be removed on the orders of the President following the receipt of the Supreme Court’s inquiry report that would be vetted by the Union Cabinet.

The apex court will carry out the inquiry on a reference being made to it by the President in accordance with the laid down procedure. If the court reports that the chairperson or such other member, as the case may be, ought on any such ground to be removed, the report would be sent to Cabinet which would advice the President accordingly.

In the Parliament, Trinamool MPs continued their protest both in the Rajya Sabha and the lok Sabha, seeking Ganguly’s removal.

Ganguly has sought four weeks’ time to respond to National Commission for Women which had asked him to explain his position. The Commission had taken a suo motu cognisance of the case and had sent notice to him on December 6 to explain his position post the indictment by the apex court panel.

In the meantime, according to sources, the law intern has sent an email to the Delhi Police stating that she was traveling and would discuss the matter later.
