GDA notice to Harish Rawat for violation of housing rules

The Ghaziabad Development Authority (GDA) has issued a notice to Uttarakhand Chief Minister Harish Rawat for violating housing construction rules. While confirming the issuance of the notice,  GDA Vice-Chairman Vijay Kumar Yadav said, “Yes, the notice has been issued  for violation of housing construction rules. The basement has been erected on the plot number GK 1/165 situated in Gyan Khand I in Indirapuram  in excess of the parameters. The floor area has also been constructed in excess of the parameters.

“In October 2014, the violation in the construction was compounded but during further inspection the enforcement department found more violation even after certain violations were compounded with the financial levy. This time two more residential units have been found beyond sanctioned limit and the basement has been found 40 per cent in excess to the sanctioned limit. The notice has been served on  Harish Rawat who is the Chief Minister of Uttarakhand and the plot is in his name,” added the Vice-Chairman.

Earlier, the Ghaziabad police  had registered a criminal case against GDA clerks for forging documents to sell the already allotted plot of Rawat in Indirapuram.

Gulab Yadav, a property dealer, had lodged the complaint with Sihani Gate police station in which he alleged that one GDA clerk Vinay Kumar lured him to buy two plots on 10/02/2010 and arranged a meeting with supervisor Chandra Pal and Virpal Raghav, who called three clerks Prashant Kumar, Rajendra and Mewa lal. They all assured to provide two plots. After waiting for over a month on 15/03/2010 they demanded Rs 25 lakh as the initial amount for the plots. Trusting them on being authority employees he paid Rs25 lakh to Mewa lal on 16/04/2010.

This gang of five clerks actively involved in the crime neither provided him the plot nor they returned his money paid to them.

On his persistent demand they gave an allotment letter pertaining to a plot situated in Gyan Khand I Indirapuram No: G K 1/ 165 signed by the then GDA Joint Secretary Shambhu Nath.  The allotment letter was in the name of Vimal Chand Mitra,  S/o Kailash Chand Mitra, a resident of IIIrd l/ 31 Nehru Nagar Ghaziabad. They demanded Rs1.20 cr for this plot. They provided another allotment letter pertaining to plot No: HIG 591 in Govindpuram. They demanded Rs 80 lakh for this 350 square metre plot. Both options were kept open against the initial amount of Rs25 lakh paid on 16/04/2010 to Mewa lal.

During last four years he had been complaining to the GDA officials but no action had been initiated by them against the clerks and the supervisors so he has come to the police to register a complaint against the erring GDA employees, the complaint said.

GDA Officer on Special Duty (OSD) RP Pandey said he received the complaint on 26/10/2013. During investigation he found that the allotment pertaining to GK I/165 Indirapuram was in the name of Uttarakhand Chief Minister Harish Rawat. No tampered document was available on file. The plot still exists in the name of Uttarakhand CM Harish Rawat. The forged allotment letter in the name of Vimal Chand Mitra enclosed with his complaint was non-existent in GDA records who had withdrawn his earnest money of Rs5 lakh on 4/12/1992 hence even the claim for a plot is invalid.

The other plot, HIG 591 in Govindpuram, was earlier allotted to one Shiela Devi but her allotment was cancelled in 1996 for failing to make the timely payment. This plot, as on GDA record, stands vacant.

“The file pertaining to plot of Uttarakhan CM  is in order. No tampered document is available on record and the construction work on the plot is going on as per the map approved by the GDA and the file pertaining to Govindpuram plot also is in order,  No tampered document is available on the file. An inquiry is being conducted in the matter,” claimed RP Pandey, GDA OSD.

On the basis of evidence provided on record a criminal case under section 420, 467 and 468 of the IPC was  registered against the erring clerks.
