The Supreme Court on Friday directed Tamil Nadu Chief Secretary to ensure no protests or agitation takes place in the implementation of court's order directing all medical admissions in the State to be in accordance with the results of the All India common entrance test called National Eligibility Entrance Test (NEET).
last month, following the SC order, a medical aspirant committed suicide as she lost out the chance to get admission in medical college after Supreme Court verdict. Earlier, the State Government had announced that medical seats will be allocated giving due weightage to the marks secured by candidates in their Class 12 exams.Following her death, protests intensified with political parties jumping into the fray and demanding State-wind bandh and agitation to stall admissions. Apprising the Court of the prevailing scenario in the State, a petition filed by an advocate GS Mani demanded that no agitation or protest should be allowed. The petition even demanded a judicial enquiry into the girl's suicide.
The Bench of Chief Justice Dipak Misra, Justices AM Khanwilkar and DY Chandrachud issued notice to the Chief Secretary and directed the top bureaucrat and the Principal Secretary (Home) to ensure no individual or group indulges in violence or disrupts law and order in any manner in protest of the SC decision on implementing NEET. The Court authorized the Chief Secretary to book such persons or groups under the appropriate law. The Bench posted the matter for hearing on September 18.
The Bench declined the request for judicial probe into the girl's suicide, but allowed the petition to the extent that it brooked no dissent to its order. Passing the interim direction, the bench said, “It shall be the obligation of the Chief Secretary and Principal Secretary of Tamil Nadu to ensure that no agitation takes place in relation to the NEET examination that has been upheld by this court.”
