A 30-year-old suffering from Thoracic Kyphoscoliosis (Spinal Curvature of the Spine) is running from pillar to post seeking a proper RTI reply pertaining to his rejection from recruitment in a Central Government agency even as he claimed to meet all requirements in the advertised category of Persons With Disability.

Delhi-based Mohd Faisal Nawaz is a physically challenged person of Muslim community who belongs to the OBC category (Ansari/Julaha). He is suffering from Thoracic Kyphoscoliosis with Post Polio Residual Paralysis at left shoulder since childhood and his disability is more than 40 per cent which is permanent in nature and thus subjected to avail all the benefits as per the Government of India rules/guidelines.

A first class Masters in Nano-technology from prestigious Jamia Millia Islamia, Faisal is currently employed at Central Electronics limited -Sahibabad ,Uttar Pradesh under Ministry of Science and Technology as a Purchase Officer and simultaneously through the proper channel he applied in July 2014 for the Post of Scientist/Sr Scientist at National Institute of Science Communication and Information Resources (CSIR-NISCAIR) under category OBC (PWD-OH) which was a reserved one within the total vacancies of four.

According to RTI query, while all the procedures three vacancies were fulfilled following a result published in March 2016, none belonging to the PWD-OH category where Faisal too was eligible were selected. Faisal was shortlisted under the PWD-OH category and had successfully cleared the screening entrance examination and was further called for the interview.

“No PWD’s were selected nor were put in the waiting list. In the posts which are identified suitable for the persons with disabilities, a Person with Disability cannot be denied the right to compete for an appointment against a reserved/unreserved vacancy. This violates the advertisement guidelines, DOPT Guidelines, PWD Act 1995, Social Ministry Guidelines,” claims the RTI application.

An RTI pertaining to the entire matter was filed with CSIR on May 20, 2016 seeking information under the RTI Act 2005. CSIR forwarded that RTI application to concerned CPIO of NISCAIR which replied on June 13, 2016. Not satisfied with the information supplied by NISCAIR, an appeal was made to the Appellate Authority of NISCAIR including the Acting Director of NISCAIR.
