National herald case : Cong for quashing trial court order, moves HC

The Congress has approached Delhi High Court for quashing the trial court order for summoning documents from Government departments in the National Herald case.

last month, Metropolitan Magistrate loveleen ordered summoning of documents after petitioner Subramanian Swamy sought records from six Government departments. The documents were sought from Income Tax, Enforcement Directorate, Registrar of Companies, Finance Ministry and departments in Urban Development Ministry dealing with land allotments.

Swamy sought production of documents from Income Tax and Enforcement Directorate about their findings in the case. He also sought the land allotment details also. This was seen as clever move to drag Government agencies in the politically sensitive case.

In the petition, Congress leaders represented by AICC treasurer Motilal Vora, said the trial court’s order of summoning documents lacks certain legal procedures including sending notices to all parties including him. The High Court is expected to hear the case on Wednesday, said the lawyers representing the Congress.

The Supreme Court last week exempted Congress leaders Sonia Gandhi and Rahul Gandhi from personal appearance in the trial court while rejecting their petition to quash the trial court proceedings.
