CBI to tell SC: No bid to derail probe

Facing criticism over alleged sabotage of 2G case, the CBI is likely to clear the allegations before the Supreme Court soon.

The agency is expected to tell the court that the DIG Santosh Rastogi related to the 2G probe was not transferred due to alleged reasons for not toeing the line of his superiors, but he had himself sought voluntary transfer four months back. However, in compliance of the SC order, the transfer of Rastogi had been cancelled and he continues to function in his earlier capacity, the sources said.

On the issue of CBI Director writing a letter to then agency counsel UU lalit, the sources said the director did not act suo motu, but had expressed his opinion following a petition by Reliance Telecom ltd for quashing the FIR filed by the agency against it. lalit, who was later elevated as a SC judge, rejected CBI Director’s opinion on the issue. The court will also be briefed about the probe being conducted by the CBI to investigate alleged link between Tata Group and Unitech for securing 2G spectrum licence, the sources said.

The agency has already registered a preliminary enquiry in the matter and also sought a report from Serious Fraud Investigation Office under Ministry of Corporate Affairs which had claimed that Unitech was a front company for the Tata group in securing 2G spectrum licence.

Advocate Prashant Bhushan, appearing for an NGO, claimed in a PIl before the SC on Tuesday that CBI Director Ranjit Sinha was attempting to reopen the whole probe on the premise that the charge sheet was based on a wrong premise. Bhushan has sought removal of Sinha from 2G probe.
