The Supreme Court on Friday declined to entertain a PIl by BJP senior leader Subramanian Swamy for constructing a Ram Temple at the disputed Ram Janmabhoomi-Babri Masjid site at Ayodhya but allowed him to intervene in the title suit pending before apex court.
Realising the sensitivity attached the issue, the Bench of Justices V Gopala Gowda and Arun Mishra refused to make any comment on the merits of the petition as it felt that no decision can be taken unless all parties to the title suit are heard.
The Bench initially viewed that Swamy should file a petition before the Allahabad High Court, later it decided to grant him permission to convert this petition into an application and intervene in the proceedings before Supreme Court.
Swamy argued that the Centre has already stated on affidavit that it will allow construction of the Ram temple if there is evidence. He cited findings of Archaeological Survey of India to this effect. He even argued that a temple once built cannot be shifted while a mosque can be shifted as it is not an essential part of Islam religion.
