Married daughter eligible for job as dependent of deceased: High Court

In an important order, the high court of Uttarakhand has stated that married daughters are also entitled to get government jobs on compassionate grounds under the quota for dependents of the deceased. Hearing on a petition regarding provision of government job under the dependents of deceased quota, the high court bench headed by the chief justice Ramesh Ranganathan stated that a married daughter is also a member of the family and has the right to secure government job as a dependent of a deceased.

The case was taken up for hearing by the bench headed by the chief justice and comprising justice Lokpal Singh and justice Ramesh Chandra Khulbe.

According to the case details, Chamoli district resident Santosh Kimothi and others had filed a petition in the single bench stating that the father of the family had died during service. He had the daughter married and later expired while still in service. Since there was no family member in the paternal family who was employed, the petitioner had sought job for self as a dependent of the deceased to enable her to take care of the family.

The single bench had directed the state government to provide government job to married daughter as a dependent of the deceased to enable her to take care of the family. The State had filed a special appeal against this after which the decision of the single bench had been referred to the larger bench headed by the chief justice. The bench headed by the chief justice had earlier kept its decision reserved and pronounced it on Wednesday.
