The Uttarakhand High Court has set the next date of hearing on April 11 of the petition filed challenging the order for termination of membership of the nine turncoat MlAs from the Vidhan Sabha. The matter was brought before the single bench of Justice UC Dhyani.
It is pertinent to mention here that the nine turncoat Congress MlAs- Subodh Uniyal, Shailarani Rawat, Harak Singh Rawat, Pranav Singh ‘Champion’, Umesh Sharma and others have in total filed three petitions in the court challenging the order regarding their membership termination from the Vidhan Sabha. On Friday, the single bench of Justice UC Dhyani heard the case and set the next date for the same on April 11.
It will be recalled that under the anti defection law, the Vidhan Sabha speaker Govind Singh Kunjwal had ordered the termination of the membership of nine turncoat Congress MlAs. This order was challenged in the High Court by the nine turncoat MlAs. The MlAs have stated that after the imposition of the president’s rule in Uttarakhand, the State Vidhan Sabha speaker did not have the authority to direct action against them. They have alleged that the assembly speaker misused his authority to order termination of their membership from the assembly.
