HC refuses Thukral's interim relief plea

Published on:

BJP MlA from Rudrapur Raj Kumar Thukral faced a major setback as the Uttarakhand High Court (UHC) on Wednesday refused to grant him any interim relief on his plea before the court for cancellation of FIR registered against him in connection with the October 2, 2011 case of Rudrapur, Udham Singh Nagar.

The aforesaid case was taken up for hearing on Wednesday, November 27 as scheduled. But the court, after some rounds of arguments during the past few days finally in its decision on Wednesday, did not grant any interim relief to MlA Thukral, said lalit Sharma, a senior lawyer  of the UHC who is fighting MlA Thukral’s case in the High Court of Uttarakhand.

Now, as per the High Court of Uttarakhand’s decision, this case has been listed for further hearing and it would be taken up for hearing after two weeks, informed Sharma. Only then it will be clear how the court deals with this case, he added. It may be recalled that the UHC after hearing the plea of MlA Thukral in this case directed the State Government on November 22 to file its reply in this case and finally refused to grant any interim relief to MlA Thukral after hearing both sides on Wednesday, as Sharma said.

In the meanwhile, it is to not that MlA Thukral who is still on the run for long to avoid arrest in connection with this October 2, 2011 incident of Rudrapur, moved the UHC after the Udham Singh Nagar police affixed a notice to his house following a local court’s order in this regard on November 20. It may be recalled that four people were killed and many others were injured when members of two different communities clashed in Rudrapur on October 2, 2011.

But recently, the State Government permitted the CBCID to register a case against BJP MlA from Rudrapur Assembly constituency Raj Kumar Thukral in connection with this case. Subsequently, the CBCID registered a case against Thukral in connection with this case and since then Thukral is on the run to avoid his arrest.

It is worth mention here that the Opposition BJP has strongly criticised the Congress led State Government for ‘raking up this case after a gap of two years’, alleging that this is nothing but a political vendetta on part of this Congress led State Government. Finally the MlA from Rudrapur had to move the UCH to avoid his arrest in this case. It is to be seen how the court now takes this case.
