The court of the Garhwal Commissioner has ordered a stay on the order of deputy registrar, Firms Societies and Chits, Dehradun dated April 4, 2013.
The stay application filed by MKP Society along with the appeal against the said order of deputy registrar was ordered on Wednesday, said MKP College society general secretary Jitendra Negi while addressing mediapersons on Thursday.
Negi said that the society had moved an appeal in the Garhwal Commissioner’s court against the order of the deputy registrar in which he cancelled the amendments made, which he himself had registered five years ago. His order was baseless and out of his jurisdiction. When no order was passed on the stay application on April 12 and 17, 2013, the society moved a writ petition in the Nainital High Court. The HC on April 25 passed an order stating that the Garhwal Commissioner would decide on the stay application. The court of Garhwal Commissioner did the needful on May 1.
Negi further said that in 2007, when the constitution of the society was amended, some members had opposed this. An inquiry into the matter was conducted by the then district magistrate Rakesh Kumar through district officer Ramindri Mandrawal. Mandrawal in her inquiry report dated February 8, 2008 stated that the changes made in the constitution were in accordance with the law.
