Court comes to rescue of married daughter of deceased employee

The High Court of Uttarakhand has found unconstitutional the rejection of applications for job by married daughter as dependent of deceased employee. The High Court has sought to know why the said benefit cannot be accorded to married daughters as dependents of the deceased.

According to the case details, Khatima resident Anjala Singh has filed a petition in the High Court of Uttarakhand at Nainital stating that her father Tej Bahadur Singh was employed on the post of cashier in the district cooperative bank of the Udham Singh Nagar district.

Stating that her father expired during 2014, the petitioner has further informed the HC that she had submitted an application for appointment to the job as a dependent of the deceased bank employee.

However, the bank management is reported to have rejected her application for a job as dependent of the deceased on the grounds that she is a married daughter of the late employee. Anjala Singh challenged the rejection of her job application in the HC where the matter was taken up for hearing before the single Bench of justice Rajiv Sharma. After hearing on the case, the HC Bench found the order of the bank management to be unconstitutional. The court found the said order to be a violation of Articles 14 (equality before law), 15 (prohibition of discrimination on the grounds of religion, race, caste, sex or place of birth) and 16 (equality of opportunities in matters of public employment) of the Indian constitution.

The application of the petitioner should be reconsidered in eight weeks, it was stated.
