lack of cooperation from the women complainants is leading to the investigation of two gangrape cases, which were transferred from some police stations of Uttar Pradesh and New Delhi to ones of Rajpur, Dehradun and Ramnagar, Nainital, to move at a snail’s pace. Both the women are said to be living in New Delhi.
After these cases came to light Uttarakhand Police sent woman sub-inspectors to record the statements of the complainants. In both the cases, SIs had recorded their statements under Section 161 of CrPC in Delhi. However, things are being delayed as the women complainants are dithering to record their statements under Section 164 of CrPC before the magistrates concerned in Uttarakhand.
Ramnagar police station in-charge Kailash Panwar said a woman, native of West Bengal, had registered a zero FIR in Bindalpur police station, South West Delhi on July 2 and later it was transferred to Ramnagar police station. She stated in the written complaint that she had reached Ramnagar along with two male friends and stayed in a hotel there. She was allegedly gangraped by four persons in a hotel in Ramnagar. A case under Sections 354 and 376 of IPC was accordingly registered against four accused — Aditya, Ashish, Chhavi and Raj, natives of Delhi.
Panwar said that when a team led SI had reached Delhi to record her statement she had refused to undergo a medical test. She had recorded her statement under 161 of CrPC, assuring that she would soon reach Ramnagar to record her statement before the magistrate. “The hotel she had mentioned in the complaint does not exist in Ramnagar. Things have got stuck and there is little possibility they would move further until she comes to Ramnagar,” he added.
In another incident, a woman teacher had registered a zero FIR under section 376 of IPC in Chandosi police station, Uttar Pradesh, alleging gang rape. later, it was transferred to Rajpur police station. Among the three accused, one was a teacher of the same school where the complainant taught. The gangrape had occurred in Rajpur area in January as per the complainant. The survivor had stated that she was a teacher in a private school, Bhaniyawala in Doiwala. The crime occurred after she had gone to the house of Manoj, native of Delhi and physical education instructor of the same school located at SAI Mandir, Rajpur Road in January, 2015. As per her allegation, Kumar had drugged her soft drink and then he along with two others had
gangraped her.
The woman SI had approached her but she has not yet come to Dehradun to help the police move ahead with the investigation.
