Amid political turmoil continuing over the much talked about Bhati Commission report, senior BJP leader and former chairman of the Uttarakhand Seed and Terai Development Corporation, Hemant Dwivedi, moved the High Court of Uttarakhand, challenging the inquiry report of the Bhati Commission.
In his application to the HC, the petitioner has also urged that there should be no action like arrest against him during the course of this case, said Sanjay Bhatt, senior lawyer of the HC, who is fighting this case on behalf of Dwivedi.
Talking to The Pioneer, Bhatt further said that as per the direction of the High Court of Uttarakhand now the State Government has to file its reply in this case before April 2, 2013. Subsequently, the petitioner has to file rejoinder in this case by April 9, 2013, he added. The case will be listed for hearing on April 15, 2013, Bhatt further said.
In his complaint, the petitioner has stated that this inquiry report is in violation of the section 8 B of the Commission of the Inquiry Act 1952. This inquiry report has been prepared without giving any chance to other party (the petitioner) to clear his stand on this issue, Bhatt further said.
The Bhati commission was set up to investigate the alleged scams of the previous BJP regime including STDC case, Citurgia land deal, 56 hydro power project allotments, irregularities in organising the Kumbh Mela and several centrally sponsored schemes and Dhaicha seed purchase to name a few.
