The district and sessions court judge has transferred the bail application of Pauri Nagar Palika president Yashpal Benam and two others — Sarita Negi and Palika’s legal advisor Ashok Bisht — to the additional district judge court in Kotdwar while fixing the date of hearing on Friday.
Benam and two other accused have been languishing in Pauri jail since August 9 after the chief judicial magistrate had rejected their bail in a case registered under Section 353 and 504 of IPC on August 10.
The Pauri Kotwali police had submitted chargesheet against the trio on June 15, accusing them of using criminal force in deterring a public servant from discharging his duty aside from abusing him. The police had lodged the case based on the report filed by the district excise officer Prabha Shanker Mishra. Though the report against them had been lodged on April 24, police had kept on dithering till the local media had forced it to register a case.
