Following difference of opinion in the joint Bench of the Uttarakhand High Court in the case of 10 per cent horizontal reservation in jobs and other facilities for statehood activists, the public interest litigation on the subject has been referred to a three-judge Bench.
In the matter of appointment of Statehood activists, the 10 per cent horizontal reservation had been challenged in the petition. On Friday, the joint Bench of justice Sudhanshu Dhulia cancelled all Government orders regarding reservation for the activists while justice UC Dhyani was of a different opinion. Considering this, the joint bench of the HC referred the matter to a Bench of three judges. The question on job reservation for the Statehood activists is an issue which elicits differing opinions from the public with many claiming it to be just while others consider it unjustified, stating that the statehood movement was a collective struggle for which only a limited number of people could not be identified and provided with benefits.
