Stay on Jat reservation to continue till June 13

Just about a week after reservation for Jats in Government jobs and admission to educational institutions under BC (C) category was stayed, the Punjab and Haryana High Court on Monday once again refused to vacate the stay for now.

Haryana government had last week moved an application seeking vacation of stay on the operation of “Haryana Backward Classes (reservation in services and admission in educational institutions) Act”.

Fixing the next date of hearing on June 13, a Division Bench Justice Daya Chaudhary and Justice Arun Palli directed all the parties in the case to file their replies by June 10, while making it clear that further adjournment would not be granted on next date of hearing.

On the previous hearing, the High Court had asked the petitioner, Murari lal Gupta, to file a reply to the government's demand for vacating stay.

In its plea, the State of Haryana has said that writ petition was not maintainable being premature at the stage of its filing. The counsel for the state said that the petitioner approached the High Court without exhausting the available channel for redressal of his grievances.

He submitted that it was mandatory for the petitioner to move Haryana Backward Classes Commission, statutory authority to entertain and examine complaints/issues raised by the present petitioner in his writ petition.

The State counsel added that the process for carrying out recruitment to various post had already been initiated by Haryana Staff Selection Commission as well as the Haryana Public Service Commission. Besides this, the admissions to undergraduate and postgraduate courses for session 2016-17 were also open; and candidates had applied under the backward classes’ category. The admission process for professional courses such as the MBBS too had started for 2016-17 session.
