Considering the large number of court cases on service matters of employees, the Haryana Government’s decision to set up a State Administrative Tribunal (SAT) is a win all step for all the employees of the State.
Besides expediting redressal of employee’s grievances and service matters, it will also reduce the pendency of cases before the Punjab and Haryana High Court.
“Haryana Government has collected information about SAT from the States of Himachal Pradesh, Kerala, Maharashtra and Karnataka and made an in-depth study of their functioning before taking the decision. The functioning of these Tribunals has been found to be very encouraging,” said a spokesperson.
Spokesperson said that the study of these Tribunals revealed that matter under the jurisdiction of the State Administrative Tribunal pending before High Court shall be transferred to State Administrative Tribunal as provided under section 29 of the Administrative Tribunals Act 1985.
“But as per proviso, the appeals pending before the High Court shall not be transferred,” he added.
He said that the number of benches is decided by the state government on the basis of number of cases filed and number of cases transferred from the High Court.
For the removal of doubts, it is hereby declared that the jurisdiction, powers, and authority of the Administrative Tribunal shall not extend to, or be exercisable in relation to, any matter in relation to which the jurisdiction, powers and authority of the Central Administrative Tribunal extends or is exercisable.
