Haryana Government has notified Relocation Policy for shifting of industries operating in the residential areas.
A spokesman of the Urban local Bodies Department said that under this policy, clusters of industrial concentration in controlled area pockets delineated as ‘residential areas’ in the development plans and having more than 70 per cent plotted geographical area within the cluster under industrial activity or use, would be considered for regularisation. This, he said, would be on the basis of actual surveys after review of the development plans by following the procedure prescribed under the Act.
“The formulation of the relocation policy has been necessitated consequent to the orders of the Punjab and Haryana High Court, who issued directions to the State for framing a policy for shifting the industrial units operating in the residential areas,” added the spokesman.
As per the norms to be followed with regard to relocation of industrial units operating in residential areas, comments would be invited from the general public on the draft before modifying and revising the development plan. In case a decision is taken to modify the land use and the development plan, the necessary provision with respect to charging of fee and prescription of zoning would be mandated accordingly. Under this policy, industries would be categorised for the purpose of relocation. These include red category industries which would be shifted with immediate effect by giving them six months and orange category industries to be shifted with immediate effect as in case of red category. However, if these units comply with pollution control norms, they may be given two years to shift to conforming areas.
Green category industries may continue to be dealt with as per the existing provisions and norms of the pollution control department and other relevant approvals from the authorities concerned. Household units may continue in residential areas provided they are not operating from HUDA sectors or other planned and approved residential colonies.
Apart from this, only non-hazardous and non-noxious industries with clearance from pollution control department would be permitted to operate from the residential areas.
Haryana Government would facilitate shifting or relocation of industrial units to the conforming areas. In case the industrial zone space falls short, additional zones would be identified and notified by the Town and Country Planning and Urban and local Bodies Departments as per their respective mandates, in consultation with the Industries Department. Accordingly, existing and new Development Plans would be marked on map and the designated industrial zones would be earmarked as the new hub of manufacturing.
Keeping in view the demographics and the social and economic impact on the shifting of industry from the residential areas, a phased but time-bound shifting is planned. The State would also identify and notify zones and areas for the industry, besides facilitating change of land use (ClU) for the mass scale shifting and relocation of the industry to conforming zones. The new Haryana Enterprises Promotion Policy-2015 envisages 31 blocks as No ClU zones and 75 Blocks as Auto ClU zones for the purpose of establishing industries. Modernisation and technological up-gradation would also be encouraged and incentivised. Green and clean technology adoption as provisioned in the new Enterprises Promotion Policy would be incentivised.
Apart from this, applicable norms with regard to pollution control would be enforced and suitable incentives and other measures, for shifting and relocation of industrial units not conforming to the land use norms would be provided as per the provisions of the new Enterprises Promotion Policy.
Tiny industries operating from the residential area that are non-hazardous and cottage industries meant to augment family incomes of those belonging to poor and lower middle classes would be identified and permitted to operate.
For effective implementation of the policy for relocation of the industry already running in residential areas of the district, a seven-member committee would be constituted under the chairmanship of Commissioner, Municipal Corporation or of Deputy Commissioner, where Municipal Corporation does not exist. This committee would include District Town Planner of the district concerned, Estate Officer, HUDA of the district concerned, Estate Officer of HSIIDC, Secretary, Municipal Committee and RO, Pollution Control Board of the district concerned as members. Apart from this, Joint or Deputy Director of District Industries Centre of the district concerned would serve as the Member Secretary. A monitoring mechanism would be put in place to ensure that the re-location policy is implemented in letter and spirit.
The spokesman said that all other permissions, licenses and consents for the purpose of manufacturing or conducting business for the Red and Orange units would stand revoked from the respective dates of end of the period and beginning from the date of notification of this policy. Traditional household industry that had been operating from the residential areas of the old towns, within the MC limits, would be permitted to operate. However, this would not be applicable to HUDA sectors and other planned and approved residential colonies as these are governed by their own Acts, Rules and Bylaws.
