The Punjab and Haryana High Court has issued notice of motion on a petition filed by Raj Kumar Saini, MP from Kurukshetra who has approached the court to get relief from allegations of
promoting enmity among social groups. The court on Thursday issued notice in which he has challenged the summoning orders of a local court in allegations of promoting social disharmony.
The notice came around two months after Kurukshetra judicial magistrate first class issued bailable warrants against Saini when he had failed to appear before the Court in connection with the complaint pending against him.
Social activist Santosh Dahiya of Kurukshetra had filed a complaint against Saini for instigating enmity among social groups. The complainant had sought action against Saini under Section 153-A of the IPC dealing with allegations of promoting enmity between different groups on grounds of religion, race, place of birth, residence, language and acts prejudicial to maintenance of harmony.
Action was also sought under Section 153-B dealing with imputations and assertions prejudicial to national-integration. The Kurukshetra court had ordered his presence on August 6 in connection with the case. In his petition in High Court, Saini through counsel Diya Sodhi has sought quashing of the Kurukshetra court orders. Taking up the petition, Justice Jitendra Chauhan issuing notice to complainant fixed August 5 as the next date of hearing.
