Petition to disqualify 4 Haryana BJP MlAs

Following the disqualification of 20 MlAs of Aam Aadmi Party in Delhi for holding office of profit, a petition has been filed in Punjab and Haryana High Court on Monday seeking the disqualification of four BJP MlAs who had been earlier appointed as chief parliamentary secretaries by the Haryana Government.

The High Court had last year quashed the appointments of CPS in Haryana following which all four of them had resigned in July. The four BJP MlAs Shyam Singh Rana, Bakhshish Singh Virk, Seema Trikha and Kamal Gupta had been appointed as CPSes in July 2015 and Chief Minister Manohar lal Khattar had himself administered oath to the party legislators.

Advocate Jagmohan Singh Bhatti had challenged the appointments saying they were unconstitutional and invalid.

Bhatti, in his latest plea, said, the MlAs should be immediately disqualified and they should not be given any pension.

The petition has been filed stating that these appointments were unconstitutional and invalid.

“The order of President as made applicable to the 21 AAP MlAs providing and approving the disqualification is supreme and deserves to be made applicable in the case of the four Haryana MlAs and ordering the disqualification as MlAs of the State legislature Assembly in the totality of the facts and the circumstances of the case,” said Bhatti in his petition.

“The mandate of the Constitution of India and the orders of the President of India are to be observed and applied in the case of four MlAs who held the office of the Chief Parliamentary Secretaries under the Government of Haryana illegally and unconstitutionally,” added he.

Reacting to the PIl, Chief Minister Manohar lal on Monday said, “There is a difference in situation between Delhi and Haryana.”

“Haryana already has a law in place for those appointments but Delhi had no such law. After Court’s order last year, we had removed the four CPSes so there is no question of their disqualification now,” he said.

On the other hand, leader of opposition and INlD’s senior leader Abhay Singh Chautala said that the government had appointed four CPSes and they were provided all facilities. The government has wasted public money by making such appointments and all such expenditure should be recovered from them, he added.
