Haryana comprehensive policy on land use out

To ensure transparency and expedite the process for grant of change of land use (ClU) in the State, Haryana Government has framed a comprehensive policy.

The policy has been framed for grant of Industrial ClU permission having investment less than Rs 10 crore or area less than one acre within conforming industrial zone by the District level Clearance Committee headed by respective Deputy Commissioners, said a spokesman of Town and Country Planning Department.

He said that the other cases for Industrial ClU permission would be considered by Empowered Executive Committee notified under the Enterprises Promomtion Policy – 2015.

In order to provide information to the public regarding pending licences and ClU applications, all the relevant information has been hosted on the website. The applications now being received are also hosted on the same website, he said.

The spokesman said that the Department has updated the website by hosting applicable Acts, rules, policies, development plans, details regarding publication of controlled areas. It has also been decided to host various other information on the website like licenses and ClU permissions, zoning plans, renewal and transfer of license, change of beneficial interest or developer, building plan approvals, occupation certificate and completion certificate.

He said that the Department had granted several licences in Gurugram for development of residential plotted colonies under the provisions of Haryana Development and Regulation of Urban Areas Act, 1975. As the Municipal Corporation, Gurugram is also keen to take over these colonies, the government has decided to get the said licenced colonies that is  DlF Ph-I to III, Sushant lok-I and Palam Vihar transferred to Municipal Corporation, Gurugram.

Accordingly, the licencees have been directed to transfer the possession of all such roads, open spaces, public parks and public health services in these colonies to Municipal Corporation, Gurugram on ‘as is where is’ basis.

He further clarified that this transfer would not be construed as grant of completion certificate under the provisions of Act No. 8 of 1975. The colonizers would thus continue to be responsible for the compliance of various terms and conditions of the license, he added.

The State Government has also implemented New Integrated licencing Policy (NIlP)-2016 which allows flexibility in the development process by prescribing the upper limit of built-up space in the form of gross FAR on the total licenced area, he said.

The concept of mortgaging of licenced land has also been introduced, provided such land should be free from all encumbrances and no third party rights should have been created. This would assist in unblocking of the finances of the coloniser by giving him financial freedom to execute the project, he added.
