Haryana Real Estate Regulatory Authority (HARERA), Gurugram, Chairman K.K. Khandelwal on Wednesday said that not providing information pertaining to plan, specifications and timeline shall be treated as violation of Real Estate (Regulation and Development) Act, 2016 and may invite stringent actions against the promoter.

Quoting a recent sitting of the HARERA bench headed by Chairman K.K. Khandelwal and members S.C. Kush and Samir Kumar, HARERA said that it has been observed that a large number of complaints had been filed pertaining to allegations of misbehaviour by the colonisers.

It has been observed that as and when the allottees contact the promoter or their representatives, the information is either not provided, or if provided then it is incomplete, a statement by the regulator said.

The allottee has the right to visit the site and can check the quality of undergoing construction. But, even after the persistent requests no such opportunity is given to the allottees and when the allottee visits the site, the security guards of the promoters not only prevent him from the lawful visit of the site, but also at times misbehave.

The treatment meted out to the allottees is not only illegal and objectionable, but also against the canon of decency and decorum, it said.

The customer relation department of the promoter also does not respond in an appropriate manner that often leads to mental agony and pain.

The regulator said it was observed that even during its proceedings the representative of the promoter rebuke, reprimand and scold the allottee in a threatening manner.

“This kind of hostility is clearly visible and requires attention in order to achieve the goals of ever growing and developing real estate sector which is currently passing through a very critical stage due to less demand and loss of faith of the consumer,” it said.
