Opposing the bail plea of an accused in Kotkhai gang rape and murder case, the CBI on Tuesday indicated that the five accused arrested by the Himachal Pradesh police may be put to further investigation if required.
Opposing the bail application of Ashish Chauhan, one of the five accused in the Kotkhai gang rape and murder case, CBI counsel Anshul Bansal said that the case, in which the petitioner was accused, was pending before the first bench of the High Court. The bail application of Ashish Chauhan was taken up by the bench of Justice Chander Bhushan Barowali.
The Bench refused to entertain the bail application and said that the case was sub-judice so it cannot hear the plea at the moment.
CBI counsel Bansal informed media that the CBI had moved an application for polygraph test of the five arrested accused before the trial court. CBI is said to be waiting for forensic and DNA sample analysis of the accused.
Ashish Chauhan and other five people were arrested by Special Investigative Team of Himachal Pradesh police, but one accused arrested by SIT had died in the police custody, allegedly following a fight between two accused.
CBI is probing the Kotkhai gang rape and murder case along with the death case of an accused in police custody. The five accused arrested by HP police had been shifted to judicial custody after CBI sleuths had made inquiries from them having taken over the probe in both cases.
