Former Union Minister and ex-Chandigarh MP, Pawan Kumar Bansal has written to the UT Administration seeking annulling of a resolution of MCC for providing essential basic public services in the premises of Group Housing Societies (GHS).
In a letter written to UT Home Secretary Anil Kumar, Bansal said that the decision of the Administration to annul the resolution of Municipal Corporation to take over the provision of essential basic public services in the premises of Group Housing Societies in the city is illogical and a betrayal on the part of Administration.
The Administration or the Municipal Corporation provide all infrastructural services like roads, parks, sanitation, street lights and electricity transformer etc. in various sectors of the city and the Administration levies various charges from the residents, including a hefty transfer fee in the form of stamp duty on sale/purchase of property.
The decision to charge similar stamp duty on substitution of membership of a Group Housing Society accompanied by handing over of possession of the flat instead of a nominal membership-transfer fee clearly conveys the intention of Administration to treat transfer of flats in a Group Housing Society at par with transfer of any other private property in the city, stated Bansal. That being the case, non-provision of basic amenities to residents of Group Housing Society flats becomes patently discriminatory and violative of citizen’s Constitutional right to be treated equally with those similarly placed, he said.
Bansal added that the Administration should reconsider its decision in the interest of justice.
