All 5 UT cops acquitted by local court

A local court on Tuesday acquitted five dismissed constables of Chandigarh police for their alleged involvement in the sensational gangrape case, involving a minor girl in Khuda lahora, around a year ago.

Additional Sessions Judge, Anshu Shukla, on Tuesday freed the five dismissed constables of Chandigarh police — Akshay Kumar, Sunil, Himmat Singh, Jagtar Singh and Anil. The court acquitted the cops after the report of Central Forensic Science laboratory (CFSl) failed to match the DNA report in the court.

The Additional Sessions Judge said the the prosecution failed to bring home the charges against the five persons for the offences of rape. The victim’s counsel could not prove that the victim was a minor. After the district court acquitted the five dismissed constables of Chandigarh police, they said they will now move the court to get their jobs. “We were dismissed from our jobs due to the rape charges against us. As we have been given clean chit by the court, we should be given our jobs,” they said.

However, brother of the victim was unhappy at the judgement. He said the court has done injustice to the complainant. “We believed on the court to punish the accused but the judgement is against me and my family. I was shocked to hear the statement of the judge, who ordered to set free the five,” brother of the complainant girl said.

“I have lost everything for the sake of this case and also received mental harassment for continuing this case, and at last the court has given the decision in favour of the accused. However, I will not let the accused go free, I will approach the higher court now,” he added. He also sought the involvement of UT administration in the case and said that he will write a letter to the Chandigarh administration to take the case to a higher court.

Brijeshwar Dutt, counsel of the complainant, said she the complainant was turning hostile again and again during the course of the court proceedings and she did not support the case, which helped the accused get the judgement in their favour.A chargesheet in the case was filed in February and two persons, Sunil and Akshay, were charged for rape and under various other sections of Indian Penal Code (IPC). The other three accused, Himmat, Jagtar and Anil, were charged for wrongful confinement and sexual harassment along with other offences.

On December 19, 2013 a complaint was registered against five constables by a 17-year-old girl, who alleged that she was raped by the accused multiple times at gunpoint.
