The Utkal Bharat on Saturday urged Governor SC Jamir to provide sanction to prosecute Chief Minister Naveen Patnaik in view of the High Court's remarks in the former DGP Prakash Mihsra case.
“After an FIR was filed against him by the Vigilance, Mishra was not selected as Director of the CBI. He was charged with corruption in shape of paying 100 per cent advance to cement and iron rod suppliers when he was Odisha Police Housing and Welfare Corporation CMD. But, Odihsha High Court quashed the FIR commenting that there was no evidence against Mishra and the Vigilance Director, in order to satisfy the political masters, had filed the case.
The judgement indicates that the Chief Minister had entered into a criminal conspiracy with Vigilance Director KB Singh in order to defame Mishra,” a four-member Utakal Bharat team led by president Kharavel Swain told the Governor while handing him a complaint letter in this regard.
Swain further informed that he had filed an FIR against the CM and the Director Vigilance in the Capital Police Station here. When the police did not take any action, he met the Deputy Commissioner of Police, Bhubaneswar, but to no effect.
Then he filed a complaint case in the SDJM Court, Bhubaneswar. “The SDJM, Bhubaneswar with extraordinary promptness dismissed my case stating that I do not have any locus standi (legal right) to file such a defamation case,” Swain said.
Informing that he intends to move the High Court against the SDJM court judgement, Swain urged the Governor go give sanction to prosecute (file a case) against the Chief Minister.
“The Governor has assured us to examine the matter. In the 68 years of independent Odisha's history, none had sought the sanction of a Governor to prosecute a Chief Minister,” Swain said in a statement.
The four others who accompanied swain to the Governor were vice-president Benudhar Samant, lawyer Biranchi Ray, Gangadhar Mansingh and Suresh Kumar Sahoo.
