Special judge to decide commercial cases

In order to facilitate the ‘Ease of Doing Business’ (EDOB), the State Government would soon designate a dedicated and specialised judge in order to adjudicate commercial disputes involving less than Rs1 crore.

As the Odisha Government is trying to make doing business easier and smoother to make the State an attractive investment destination, this new legal facility for the business is required to be extended as such cases are pending for years in the general courts which need to be resolved on a fast track basis.

Now, senior officials of the law and Industries Departments are engaged in working out details for such an innovative initiative, said sources.

A senior official in the State Government said that the rationale behind the designation of a dedicated and specialised judge to adjudicate commercial matters of less than Rs1 crore is a natural step as the Commercial Courts can only deal with the matter of more than Rs1 crore.

Therefore, matters below Rs1 crore would have to be filed in general courts, where judges neither have expertise nor are adept in dealing commercial matters. Further, the matter would be added in the heap of pending cases and would take years to get decided.

Therefore, these dedicated courts may be presided over by expert judges and may work as Commercial Courts, where cases of commercial disputes involving less than Rs1 crore may be assigned.

This move started with Union law Secretary, Suresh Chandra bringing it to the notice of the State Government to go a step ahead on eases of doing business in the State with this legal facility for industries.
