The Supreme Court on Monday issued an interim stay on the Odisha High Court decision pertaining to the election to the Brahmagiri Assembly constituency held in 2014, giving relief to incumbent MlA Sanjay Kumar Dasburma.
Earlier, the High Court had rejected Dasburma’s plea for disposal of a case filed by Congress candidate lalatendu Bidyadhar Mohapatra challenging Dasburma’s win without a hearing. Challenging this order, Dasburma had filed a special leave petition (SPl) at the Supreme Court.
Conducting a hearing on the SlP, a bench of Justice J Chelemswar and Ajay Manohar Saphre has issued a notice to Mohapatra and put an interim stay on the first hearing of the High Court.
On behalf of Dasburma, Supreme Court senior lawyer V Giri, High Court senior lawyer Bidyadhar Mishra, SC advocate-on-record Ashok Panigrahi and HC lawyer Taranikant Biswal managed the case.
