But court says no to donating body parts after death

One of the two petitions filed by Maoist leader Sabyasachi Panda was rejected by the SDJM here on Wednesday. Panda had filed a petition in the court through the local Jail Superintendent praying for providing necessary facilities to him to write books in the jail and to facilitate its publication after completion of the book.

In the second petition, he sought permission that immediately after his natural death, each and every part of his body be donated to the poor, destitute, orphans and Dalits, to which Government Advocate Pradeep Kumar Behera strongly objected, sources said. The court ruled that this petition is not legally tenable.

However on the petition seeking permission for writing books, the SDJM ruled that as per the Jail Manual, Panda can write books while in jail. After rejection of the petition for donation of body parts, Panda’s lawyer Deepak Behera said his client would challenge the SDJM’s order in higher court.

The court had fixed Wednesday to hear the case pertaining to the alleged supply of deadly weapons by Panda. Though the witness in the case, Sudam Nayak, was present in the court premises, he could not produce the copy of the summon served on him as well as his ID proof, for which the Government Advocate refused to examine the witness. The court accordingly fixed September 15 for the purpose.

Meanwhile, Sabyasachi Panda complained before the court that while bringing him to the court some police officers forcibly removed his spectacles and threatened to kill him. Since no written complaint on this issue was filed by the Maoist leader, the court did not accept the contention, said the Government Advocate.
