--Court orders sale in public auction: The Odisha Protection of Interests of Depositors (OPID) Court in Cuttack has confirmed the attachment of property of more than Rs 2 crore of real estate firm Surya Nirman Resources Pvt Ltd in connection with a land fraud case worth Rs 2 crore.
In 2017, the Economic Offences Wing (EOW) of Crime Branch registered a case against Surya Nirman Resources and its managing director Chinmay Mallick, directors Rojalin Mallick and Biswajit Pattnaik, who allegedly collected public deposits of more than Rs 2 crore under the pretext of providing litigation-free plots at Chandaka or otherwise to pay back the invested amount with high returns through its different money back policy or schemes like ‘Jeevan’ and ‘Jeevan (Gems)’.
During investigation by the EOW, the details of moveable/immoveable properties standing in the name of the company and its directors were collected from IGR, Cuttack and landed properties of 17.46 acres at Krushna Nagar, Chandaka, Kantabada in Khordha district and Kujang and Padampur under Jagatsinghpur district were traced to be in the names of the company and its directors.
An ad-interim proposal for attachment of the above landed properties worth Rs 2,07,85,349 was submitted by the EOW on March 7, 2018 under the provision of Section 3 of the OPID Act to the Finance Department and, accordingly, the above landed properties were attached in April 2018.
“Designated Court under OPID Act, Cuttack made the ad-interim order of attachment absolute (confirmed) and directed competent authority i.e. ADM-cum-competent authority under the OPID Act, Cuttack, to sale the immovable properties through public auction for equitable distribution of the proceeds among the investors/depositors,” the EOW said in a reported release.
