The Rayagada Superintendent of Police (SP) and the Mayurbhanj Collector-cum-District Magistrate (DM) have been asked to appear before the National Human Rights Commission (NHRC) on Friday over noncompliance of its direction in two different cases.

The commission on January 21 had issued conditional summon to Rayagada SP K Siva Subramani for personal appearance but observed that the officer may be dispensed from appearance, if compliance was made out on or before March 11.

However, no response was filed by the SP as yet.

“Despite sufficient time and opportunity having been given, the requisite reports have not been received. In these circumstances, let summons be issued for the personal appearance of Rayagada SP before the commission on March 18 at 11 am along with the requisite reports,” the commission ordered in its conditional summon.

The summon was issued on serious lapse and con-compliance with the direction of the commission by the authorities concerned while dealing with a case pertaining to torture of three tribal school students in police custody.

The order came upon a complainant filed by rights campaigner Subash Mohaptra, who had sought appropriate action against the officials of Chandili police station in Rayagada for torture committed on three tribal students identified as Ashok Pedentui, Basant Pedenti and Brajra Kadraka.

“The students were picked up from their school and subjected to torture and inhuman degrading treatment in police custody on mere suspect of theft of a mobile phone. The juveniles were not dealt with as per the provisions of Juvenile Justice (Care and Protection) Act, 2000 as amended in 2006”. Mohapatra alleged. The incident occurred on September 8, 2013.

In another incident of outraging of modesty of a tribal woman, who was denied financial relief under SC/ST (Prevention of Atrocities) Act, the commission also had issued conditional summon to Mayurbhanj DM Rajesh Prabhakar Patil to appear before it in person at 11 am on Friday along with requisite report.
