Every death sentence in our country arouses a lot of public debate in our country .The belief behind this is this type of harsh law may lead to other consequences .It gives us enough scope to introspect. We can recapitulate some dreadful incidents that happened in our country in near past like the December, 2014 Delhi gang rape case, terrorists’ attack of Mumbai in 2008 and the bomb blast of 1993 in the same cit, attack on the Indian parliament in 2001, attack on the Akshardham temple in Gandhi Nagar in 2002. Similarly, no Indian citizen can forget again the horror of Mumbai serial blast in 2011 in which 21 people were killed and approximately 133 people were injured.
Now in these cases, if the culprits are awarded capital punishment, what’s wrong in itIJ Does a rapist or terrorist after committing a heinous crime deserve any mercyIJ Basically, punishment depends on the nature of crime and intensity of the crime. Crime is the most determining factor. It is true that most of the debates have become emotional after a particular period of time .Capital punishment is still prevailing in some of the western countries and the USA is also one of them.
I hope that everybody would believe that the State has it primary role to protect its own citizen. It was created with the primal need for the people to be subjects of a sovereign power whose duty is to protect people, country and ensure their well-being according to the constitution of our country. Thus it becomes incumbent upon a State to create a system and run its machinery for smooth governance. Here ‘Statehood ‘ is most important .A State or country with its due process of law, if required, can take the life of an individual or a group who are deemed to be a threat to the State, its sovereignty and integrity. Thus “death penalty” is not only acceptable but also a necessary duty imposed upon a country as part of its obligations and proper governance. It cannot be termed as unnatural and uncivilized but quite justified and essential because it is very difficult to transform such devils. Only fear of death penalty may deter them from indulging in such heinous crimes. One death penalty will make thousand others fearful of even dreaming about committing an obnoxious crime. Moreover, recent studies have revealed that in most of the heinous crimes comes from blood or in simple words ,we can define that the act of such crime is usually inherited through genes .If we go back to our popular epic ‘The Mahabharata’ or sacred book ‘The Gita’, it is observed that lord Srikrisna motivated Arjun to kill his cousin Duyrodhan and his own brother Karna because they were the threat to the whole kingdom. Duyrodhana and Karna insulted Draupadi in front of everybody and ultimately ‘death penalty’ was offered to them as ‘Raj Dharma’
The Supreme Court of India has already cleared that if a particular crime is ‘rarest of the rare’ and mercy plea in the case is rejected by the supreme head of our country, the President, for the gravity of the crime, in that circumstance there is no alternative of capital punishment.
