PIl challenges PWD Commissioner appointment

Published on:

A PIl has been filed in the High Court challenging the notification dated April 7, 2015 issued by the Women and Child Development Secretary appointing Dr Minati Behera as the State Disabilities Commissioner.

Petitioner Suresh Choudhury alleged in the PIl that the State Government has illegally appointed Dr Behera for the coveted post of Disabilities Commissioner in contravention of the provisions of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act 1995 and consequently affecting the welfare conditions of Persons with Disabilities (PWDs) in the State of Odisha.

A two-member Bench headed by Chief Justice DH Waghela had heard petitioner’s learned counsel on September 4 and issued notice to the State Government, the Women and Child Development Department Secretary and the Disabilities Commissioner on the question of admission.

The Bench mentioned in the notice that the matter shall be decided at the state of admission.

The matter is listed to be heard on October 5.
