The District Consumer Disputes Redressal Commission, Sundargarh-II, Rourkela, directed the manager of a petrol pump to compensate a consumer for cheating and harassing him while he had gone to fill diesel in his truck five years ago and made the payment through swapping his card on point of sale (POS) machine.
Pancham Sinha, a resident of Jalda under the Raghunathpalli police station, had filled diesel in his truck on 17.02.2018 at Fetcol Petrol Pump (Indian Oil) at Jalda and swiped his card before the manager of the Petrol Pump. An amount of Rs 8,443 was deducted from his account but the manager of the petrol pump denied having received the payment despite Sinha showing him the receipt. The manager demanded the payment again and finding no other alternative, the complainant paid Rs 8,443 to the petrol pump in cash.
Thereafter, Sinha made a complaint before State Bank of India, Jalda branch and accordingly SBI, Jalda branch gave him the details of transaction and deduction of the amount from which it became clear that Rs 8,443 had been debited from his account and credited in the account of Fetcol Petrol Pump and the manager of Fetcol Petrol Pump knowingly with malafide intention harassed the complainant Sinha and had taken the amount twice.
Sinha had later lodged a complaint with the District Consumer Disputes Redressal Commission, Sundargarh-II, Rourkela on 2.06.2018.
Pronouncing the judgment of the case on March 17, president Rajesh Prasad and member Sadanana Tripathi of the District Consumer Disputes Redressal Commission, Sundargarh-II, Rourkela, directed the manager, Fetcol Petrol Pump to pay an amount of Rs 8,443 with 6% interest per annum to the complainant from the date of swipe of ATM card i.e.17.02.2018 along with Rs 50,000 to the complainant towards compensation for losses, deficiency of service and gross negligence. The court further ordered that all the directions are to be complied with within one month from the date of the order failing which the amount will further carry 9% interest per annum till the date of actual payment.
