Taking serious view of the noncompliance of its directions over death of a school student due to corporal punishment, the National Human Rights Commission (NHRC) warned the School and Mass Education (S&ME) Secretary and Dhenkanal SP to invoke Section 13 of the Protection of Human Rights Act, 1993.
Section 13 of the Protection of Human Rights Act, 1993 may attract the officials for personal appearance before the commission.
Angul-based Human Rights Watch secretary Sangita Swain had moved the commission alleging that Saktiman Nayak son of Birabar Nayak of Santapur village under Gandia police station and a student of Santhapur High School died due to corporal punishment and physical torture meted out to him by teachers Ajay Nayak and Sanjay Bhoi local sarpanch Gourahari Swain on February 14, 2015.
Despite issuance of notice and lapse of considerable time, the officials failed to submit the requisite reports.
“let a final reminder be sent to the concerned authorities under registered post calling for requisite report within four weeks, failing which the commission shall resort to Section 13 of the Protection of Human Rights Act, 1993,” said the latest order of the commission.
The petitioner has prayed the commission to take criminal/disciplinary proceeding against the accused and a compensation of `20 lakh to the kin of the deceased.
