The Mediation Centre in Palamu civil court has its hands full of cases. According to the co-ordinator of the Mediation Centre (MC), KK Jha, who is the secretary of the Palamu legal services authority, majority of cases coming over to MC are of marital discord which comes under 498(A) of the Indian Penal Code and sadly this section is mostly abused and misused.
However, in the Mediation Centre, came up a case of a very different nature, said Jha.
According to Jha, one Anil Kumar Singh of Chainpur gave his petition in Hindi dated 11.3.14 addressed to the secretary Palamu legal services authority urging the authority to intervene in the matter of his son’s promotion to class IX.
The petitioner, Anil, has mentioned in his petition that his son’s promotion to class IX was held up by the school authority where he studied till class 8, causing immense mental agony and bouts of depression to his son.
Anil’s son is a student of a prestigious school located in Chiyanki.
As the latest Act on child’s rights and protections forbids using name of the child, The Pioneer, in respect to this, is withholding the name of the child along with the name of the said school where Anil’s son is a student inorder to avoid further problems.
Jha said on the basis of the petition of Anil, notices were served to the principal of this school who was the
respondent. A pre litigation case (number 17/14) was drawn against the school, added Jha.
However, on 15.4.2014, Anil again wrote to the secretary of Palamu legal services authority them to drop the pre litigation case against the school, as Anil in his petition explained that the principal of the school had assured him of his son’s promotion.
Therefore, Anil do not want to pursue this pre litigation case any further and the matter be dropped.
Jha added in the wake of Anil’s petition wherein he prayed for dropping of the pre litigation case against the said school, the matter was dropped and disposed of as Anil by his own version looked satisfied with the assurance of promotion and thus this pre litigation case deserved no further pursuance.
legal sources said this case is first of its kind here in Palamu and for this the secretary, KK Jha, is given all kudos for making the legal services authority here a popular forum to get grievances/complaints redressed without
any rupee being spent by the aggrieved.
