lawyers protest against Registration Act amendment

The Capital Bar Association and the Bhubaneswar Bar Association on Monday jointly demanded immediate withdrawal of the amendment to the Section 22-A of the Registration Act, 1908, which requires the production of the Records of Rights (RoRs) (land Pattas) before any land is registered.

In a joint Press conference here, Capital Bar Association secretary Gobinda Patnaik said, “The amendment is ridiculous. The State Government on February 22, 2014 has issued a Gazette notification regarding amendment to the Section 22-A of the Registration Act in which sale of land cannot be registered without production of RoR before the concerned registering authority. But it is impossible for many to produce pattas while selling their properties.”

“When a father dies, the land patta does not come to the name of his son or daughter. Similarly, when a person is buying an apartment, he is never given a patta. So, when they want to sell their properties in emergencies, they face problems as they have no pattas. Hence, there is no justification to make the production of RoR mandatory while selling land,” said Bhubaneswar Bar Association president Tusharkanti Mohapatra.

“We demand immediate withdrawal of the amendment, failing which lawyers across the State will resort to agitation,” warned Odisha Stamp Vendors’ Mahasangh secretary Ramakrushna Parida.
