HC notice to Sarkhel in bail recall case

Admitting a petition filed by the State Government to recall the bail granted to Congress leader Arindam (Bapi) Sarkhel, the Orissa High Court on Wednesday issued notice to Sarkhel to show cause as to why the bail granted to him on April 17 shall not be recalled.

The court had last month granted the bail to Sarkhel, who was arrested by the Paradip police in November last year for his alleged involvement in the Seaways Shipping general manager (GM) Mahendra Swain murder case. Sarkhel was released from the Choudwar jail.

But alleging procedural flaws in the bail hearing, the Government had filed a miscellaneous case in the High Court urging the court to recall the relief granted to the accused. Justice DP Choudhury on Wednesday admitted the Government’s petition and issued notice to Saarkhel asking him to file counters.

The High Court also on the day adjourned the bail hearing of industrialist Mahimananda Mishra to Friday when Public Prosecutor Janmejaya Katakia sought some more time to study the case. Mishra, who was granted bail by the court on Tuesday in the Swain murder case of Paradip, is also booked for an attempt-to-murder case in Cuttack.

An advocate of the Orissa High Court, who allegedly had an enmity with Mishra, was injured in a bombing incident that took place in April 2013 near Press Chhak of Cuttack under the Madhupatna police station. Although the case was closed in 2014, Mishra was booked by the city police in January this year after he was arrested by the Paradip police in the Swain murder case.
