Barsa to challenge in-laws' DV exclusion in High Court

A day after the District and Sessions Judge Court, Baleswar excluded former Minister Raghunath Mohanty and his wife Pritilata as parties in the domestic violence (DV) case, their estranged daughter-in-law Barsa Swony Choudhury, who had filed the case, on Sunday said she would move the Orissa High Court challenging the verdict.

“The lower court has delivered its verdict on the DV case filed by me. I have not gone through the court order copy yet. I will examine it and move the High Court after it reopens,” she said.

Notably, the High Court would reopen on March 10 after holidays.

Barsa had filed the DV case at the Sub Divisional Judicial Magistrate (SDJM) Court here against her husband Rajashree Mohanty and parents-in-law.

later, the five-time Basta MlA Raghunath Mohanty and his wife had filed a petition in the SDJM Court seeking exclusion of his and his wife’s names as parties in the case. After a series of hearings, the court rejected the plea on January 30.

Rajashree had also moved the District and Sessions Judge Court on July 24, 2015 seeking dropping of DV charges against him. However, the court rejected Rajashree’s plea. Earlier, a similar plea field by him in a lower court had also been rejected.

On March 14, 2013, Barsa had filed a case accusing Rajashree, her parents-in-law, Raghunath and Pritilata, sister-in-law Rupashree Madhual and brother-in-law Suvendu Madhual of torturing her physically and mentally for dowry.

Conducting a hearing on an alimony case on January 14 this year, the Baleswar Family Court had directed Rajashree to pay Barsa a monthly interim maintenance of `25, 000.
