SC turns down hoarding petitioners' stay plea

In a major relief to the Bhopal Municipal Corporation (BMC), the Supreme Court on Monday turned down the plea of hoarding petitioners for stay on a High Court order, paving the way for the BMC to take action on the issue.

The apex court did not provide any relief to the hoarding petitioners against the Madhya Pradesh High Court (MPHC) order dated March 12, 2015 given in favour of the BMC.

The hoarding petitioners had filed petitions in the MPHC against the BMC. The MPHC acting on the petitions turned down 17 such petitions and let the BMC take action under which the hoarding petitioners were to pay seven years amount with interest as per the rates fixed under Collector guidelines.

The hoarding petitioners knocked the doors of the apex court against the High Court order seeking relief and demanded stay on it. The Apex Court while hearing the petition on Monday refused to provide any relief to the petitioners and turned down their petition paving way for the BMC to take action on the issue while the hearing in the case would continue in the Supreme Court.

Notably, the bench of the MPHC comprising of Justice Rajendra Menon and Vandana Kasrekar in their decision on March 12 this year rejected 17 petitions against the BMC letting the civic body take action in the issue. The petitioners had challenged the BMC order to hike the rates as per the Collector’s guidelines. The High Court justified the BMC action and let it proceed on its order.
