SC stays HC order on Saklecha termination

After his membership from Madhya Pradesh Assembly was terminated on the basis of High Court verdict, Independent legislator from Ratlam City Paras Saklecha got relief from Supreme Court in the case on Monday.

The Apex Court, hearing the plea of Saklecha, stayed the High Court verdict. With this, the State assembly officials are puzzled, as they have already issued notification vacating the seat. Acting on a petition filed by BJP leader Himmar Kothari, in April this year, the Indore bench of the MP High Court had set aside Saklecha’s election in 2008 on the ground that he had launched a misleading campaign against his BJP rival Kothari. later, the BJP leader filed an election petition with the HC.

On the basis of the High Court judgement, Madhya Pradesh Assembly had two days ago declared as vacant the Ratlam city Assembly seat after the nullification of election of independent MlA Paras Saklecha. The notification declaring Ratlam city seat as vacant was issued by the State Assembly’s Principal Secretary, Rajkumar Pande. As a result of this notification, Saklecha ceased to be a member of this House with effect from June 20, it added.Since, the copy of the stay has not been received here, the assembly officials are not willing to speak out anything over the issue.
