The defamation suit filed by Noor-us-Sabah Residency Housing Project against the secretary of the Saifia Education Society Zainuddin Shah has been accepted by the local court that has issued notice to the latter for appearing before it.
The court of Civil Judge first class Abhilasha N Mawar admitted the plea of M/s Allegiance Infratech Private limited that was earlier Noor-us-Sabah Hotels and Properties limited, Noor-us-Sabah Residency Housing Project Private limited and Sikandar Hafiz Khan on August 5. The court also issued summon to the accused Shah to appear before it on October 14.
The court in its order said that on going through petitioners’ plea with the supporting documents submitted, it appears prima facie a clear cut case under Section 500 of the IPC against the accused Zainuddin Shah. There seems much base to take cognisance in the case under the said Section of the IPC. A case should be registered against him, the court said.
The petitioners in their plea through their advocate Dipesh Joshi pleaded that Shah is creating hurdles in the project by misguiding people and has also made attempts to get a court stay over the project by misguiding the court. Shah’s plea was however dismissed by the High Court on June 24, this year.
Notably, M/s Allegiance Infratech Private limited, Noor-us-Sabah Residency Housing Project Private limited and Sikandar Hafiz Khan have joined hands to come up for a project located in prime Ahmedabad (Koh-e-Fiza) locality of the State capital.
