No permission for SIMI detenu to sit for exam

The court of Chief Judicial Magistrate (CJM) Bhopal, Pankaj Maheshwari, has denied permission to Javed Nagori, activist of the banned Students Islamic Movement of India (SIMI),  to appear in his university examination. Nagori was arrested by the Anti-Terrorist Squad (ATS) along with three of his accomplices in Mehidpur in Ujjain district of the State on December 31 night. The ATS also recovered a huge cache of explosives.

He is a private student of MA Economics in Ujjain's Vikram University. His exam centre is Mehidpur. His second semester exam are scheduled from March 19 to April 2 at Government College, Mehidpur for which he had appealed to be shifted to Mehidpur prison and allowed to appear for his exams under police watch.

The ATS submitted that Mehdipur jail was not safe enough to hold an undertrial terrorist and transportinghim for exams from Ujjain prison was not feasible. In the light of the Khandwa jail break last October, the MP High Court had in December ordered all major terror accused to be shifted to Bhopal Central Jail.

On these grounds, the Bhopal CJM denied Nagori's request on Saturday.Nagori's lawyer Parvez Alam called it “a violation of the constitutional right to education”. Alam further said, “The order has come so late that we can't even appeal as there are holidays. Denying him a chance to get ahead in life, when he has not even been convicted, is most unfortunate.”
