MP Anusuchit Jati- Janjati Adhikari Evam Karmachari Sangh (AJJAKS) claimed that the MP Promotions Rules 2002 was formulated following the provisions in the Constitution.
AJJAKS general secretary (administration) SK Suryavanshi while talking to the media persons here on Wednesday said that the main reasons behind providing reservation in promotions was lesser representation of Schedule Caste (SC) and Schedule Tribe (ST) and backwardness of SC and ST communities. “In this rule no compromise was made in administrative efficiency because the CR grading was similar for all,” Suryavanshi said.
Notably, AJJAKS is opposing High Court judgement dated April 30, 2016 quashing the provision of reservations in promotions in MP Service Rules 2002 and is all set to challenge the High Court order in the SC.
Suryavanshi further said that the Supreme Court also in its verdict in case of M Nagraj in the year 2006 instructed that the state governments could make rules for reservation in promotions but for that they would have to prepare data of three things in 60 days as per rules. Those three conditions include to limit the SC, ST reservation up to 50 per cent, Indequancy of representation class wise and post wise in promotion and that the government should provide quantifiable data of backwardness of SC and STs, he added.
He said that the Madhya Pradesh Government before 2006 and after that used to collect this data but could not put it in right manner before the High Court due to that the HC verdict on April 30 came against it. Now we demand that the State Government should pass resolution to request the central government to pass the pending reservation bill. State government should appeal in competent manner the Supreme Court against the HC order and the state government should prepare quantifiable data within ten days, he added.
