In an important decision, the Indore bench of the Madhya Pradesh High Court here on Tuesday rejected and set aside a petition of the Dawa Bazaar Association against Arogya Retail Private limited.
The Association in its petition before the High Court had accused both the Red Cross and the Indore district administration of providing space to Arogya Retail Private limited to set up its medicine kiosks at Dhakanwala Kuwan and Khajrana localities wrongly.
Taking cognizance of the petition, a joint bench of the Indore bench Madhya Pradesh High Court comprising Justice PK Jaiswal and Justice Virendra Singh had reserved its decision and finally delivered its judgement on Tuesday. Ajay Bagadia was the counsel for Arogya Retail.
The standoff between Dawa Bazaar Association and Arogya Retail had been continuing in the city since long. The Association had objected to Arogya Retails's move to provide medicines to city people at discounted rates and accordingly had even stopped supply of medicines to it.
Proprietor, Arogya Retail KP Singh said that Dawa Bazaar Association is objecting to our move to provide medicines to city people at our medicine kiosks all over the city at a discounted rate of 20-75 per cent. Singh said that he was following all the legal provisions while giving medicines to people at discounted rates.
