MP Samanya, Pichda Varg, Alpsankyak Adhikari/ Karmachari Sangarsh Morcha’(MPSPVAAKSM) alleged that the State Government has acted in contempt of the High Court’s decision in the case of reservation in promotion, passed on April 30, 2016.

While talking to the media here on Sunday, the convener of the MPSPVAAKSM, Ashok Pandey said that the State Government has called a review meeting to discuss upon the benefits under promotion through reservation received by the Chairman of National Commission for Scheduled Cast/ Scheduled Tribe under the Reservation Act 2002 in spite of the decision being revoked at Ministry level. This is absolutely in contempt of the High Court’s decision, he added.

Pandey further said that State government is preparing to appeal in the Supreme Court against the ruling of the High Court. In a meeting in this regard, held on May 1, 2016, the OIC KK Kathiya, Additional Secretary Ministry General Administration Department, took part and at the same time, in a contradicting statement, he also suggested fighting against the State government, he added.

After being appointed as an OIC, no officer is allowed to part in a meeting; let it be of any organization as per the Civil Service Conduct. Also the State Government has appointed Kathiya as OIC who has taken advantage of the ‘Reservation rule 2002’ thrice, but the question is how such a person is going to present impartial and truthful information before the Supreme Court he added.

Morcha co-convener Anil Vajpayee said that thus KK Kathiya must be removed from the post of OIC and someone impartial must be appointed. If the State government does not heed to the demands of the MPSPVAAKSM, it will file a petition in High Court regarding the contempt of the Court’s decision and if the directives of the High Court is not taken seriously then the MPSPVAAKSM will protest against the State government on May 10, 2016, he added.
